NearMe connects users with local vendors. We do not control or participate in any service, delivery, or transaction.
We are a platform that facilitates discovery and connection between customers and local businesses. NearMe does not provide, fulfill, or guarantee any products or services listed by vendors.
2. Account Responsibilities
Users must:
- Register with truthful and accurate information
- Not misuse the app for spam, impersonation, or fraudulent activities
- Users are responsible for all activity conducted through their account.
- Maintain the security of their account credentials
- Be at least 13 years of age to use the platform
3. Vendor Engagement
Important Disclaimer: NearMe is not responsible for:
- Vendor performance or reliability
- Quality of products or services
- Disputes, delays, or payment issues between user and vendor
- Any financial losses or damages arising from vendor interactions
Please perform your own due diligence before engaging in any transaction or service agreement with vendors discovered through our platform.
4. Advertisements
This app displays banner ads via Google AdMob.
NearMe is not responsible for the accuracy, legality, or safety of products or services advertised by third parties.
- Do not click on ads unnecessarily or repeatedly (click fraud is prohibited)
- Google may collect ad interaction data and use anonymized identifiers
- Ad content is provided by third-party advertisers and does not constitute endorsement by NearMe
5. Intellectual Property
All content, trademarks, and intellectual property on NearMe are owned by us or our licensors. Users may not:
- Copy, modify, or distribute our content without permission
- Use our branding or logos without authorization
- Reverse engineer or attempt to extract our source code
6. Prohibited Activities
Specific Prohibited Items: Users and Vendors are strictly prohibited from listing, promoting, or facilitating the sale of the following:
6.1 Alcohol & Tobacco Products
- Any alcoholic beverages, including beer, wine, and spirits
- Cigarettes, vapes, electronic nicotine delivery systems, or nicotine-related products
- Smokeless tobacco or related products
6.2 Regulated Goods
- Firearms, ammunition, or explosives
- Prescription-only medications or controlled pharmaceuticals
- Weapons or dangerous items prohibited under Indian law
6.3 Adult Content
- Sexual services or escort services
- Nudity or adult-themed entertainment
- Sexually explicit materials or adult products
6.4 Illegal Drugs & Substances
- Any recreational drugs or controlled substances prohibited under Indian law
- Drug paraphernalia intended for consumption of illegal substances
6.5 General Prohibited Activities
- Post false, misleading, or fraudulent content
- Harass, abuse, or harm other users or vendors
- Attempt to hack, disrupt, or compromise our systems
- Use automated bots or scrapers on our platform
- Violate any applicable laws or regulations in India or internationally
7. Limitation of Liability
To the fullest extent permitted by law, NearMe and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform or any interactions, transactions, or disputes between users and vendors.
NearMe provides the platform on an “as is” and “as available” basis and makes no warranties regarding the quality, safety, legality, or performance of any vendor or service.
8. Changes to Terms
We may update these terms periodically. Continued use of the platform after changes constitutes acceptance of the new terms. We encourage you to review this page regularly.
9. Termination
We reserve the right to suspend or terminate your account at our discretion, without prior notice, if you violate these terms or engage in harmful activities.
10. Governing Law
These terms are governed under the laws of India. Any disputes shall be resolved in the courts of competent jurisdiction in India.

12. No Warranty
The platform is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted, error-free, or secure operation of the app.
13. Content Moderation & Reporting
As a user-generated content platform, NearMe implements a proactive "Notice and Take Down" policy in compliance with the Information Technology (Intermediary Guidelines and Digital Ethics Code) Rules, 2021 and IT Rules 2026:
13.1 User Reporting Mechanism
- Every listing on NearMe includes a reporting mechanism
- Users are encouraged to report any content that violates these Terms of Service or applicable laws
- Reports are reviewed promptly by our content moderation team
13.2 Rapid Content Removal
- In compliance with IT Rules 2026, NearMe will act to remove reported illegal content or content requested by authorized government agencies within mandated timeframes (typically 3 to 36 hours depending on the nature of the violation)
- Emergency cases involving threats to public safety will be handled with higher priority
- Users will be notified of action taken on their reports
13.3 Vendor Termination Policy
- We reserve the right to permanently ban any vendor who repeatedly lists prohibited items without refund of any promotional credits, account fees, or balance
- First-time violations may result in listing removal and warning
- Repeated violations will result in immediate account termination
- Serious violations (such as listing adult content or illegal drugs) may result in immediate permanent ban
13.4 Intermediary Status
NearMe acts as an intermediary under Section 79 of the Information Technology Act, 2000. We do not exercise editorial control over user-generated content and remove content upon notification of violations or legal request from authorities.
